Chapter 1: General Provisions

Article 1 (Purpose)

The purpose of this agreement is to define the conditions and procedures regarding the use of any services (the "Service") provided by Medicircle homepage

Article 2 (Definitions)
  1. 1. User: The receiving party accepts the services that are provided according to Medicircle
  2. 2. Use of Contract: with regard to service contracts concluded between users and Medicircle
  3. 3. Sign-up: Fill of information provided on the application form of Medicircle, and the act of completing a service contract you agree to these Terms and Conditions
  4. 4. Member: Members who have registered to provide personal information necessary to register on this site
  5. 5. ID: A combination of letters and numbers that users select and Medicircle approved for membership and identifies members of the Service
  6. 6. Password: A combination of letters and numbers selected by the user for protection of his/her personal information.
  7. 7. Cancellation of the Service: The expression of the intention of either the user to terminate the use of the Service.
Article 3 (Validity and Changes of the Agreement)
  1. 1. This Agreement shall become effective when the user subscribes to the Service and accepts the provisions of this Agreement, which will be displayed on the Service screen or put on public notice.
  2. 2. Medicircle reserves the right to amend this agreement, either partially or wholly, from time to time, as required. The amended agreement will be put on public notice on the service screen so that the user may see it.
  3. 3. The user may stop using the service and cancel his/her registration as a member, if he/she does not agree to the amended agreement. The user has continued use of the Service will constitute his/her consent to the amended agreement.
Article 4 (Application of Provisions)

Concerning matters stipulated in this agreement, this agreement shall prevail over other relevant laws and regulations. Concerning matters not covered by this Agreement, relevant laws, regulations, or commercial practices, such as the Telecommunications Business Act.

Chapter 2: Contract for Use of Service

Article 5 (Conclusion of Contract)

The Contract for the use of the Service shall be deemed to have been made automatically by the user’s consent to the provisions of this agreement.

Article 6 (Application for the Use of the Service)

The user shall apply for the use of the service by filling in his/her personal information as required by the form provided by Medicircle on the member agreement.

Article 7 (Consent for use of application)
  1. ① A member shall submit personal information as required through the information management process. All responsibilities shall lie with the member in this respect including any penalties that may result from his/her failure to update their personal information.
  2. ② You may not consent to its use in the case of the following.
    1. 1. When your do not apply with real name.
    2. 2. When you apply using someone else's name
    3. 3. If the contents of application are false
    4. 4. If the customer does not applied in the order required
    5. 5. Or, if the customer doesn't satisfy the requirements of the service use application prescribed by the Medicircle
Article 8 (Agreement changes)

Members must modified if changes have been made as described at the time of application use, and the members are responsible for problems that occur by not modified information.

Chapter 3, (Obligations of the contracting parties)

Article 9 (Obligation of Medicircle)

Medicircle does not disclose or distribute any of the personal information of members who know with respect to services provided to third parties without your consent. However, it does not apply in the following events: When there is a request from a relevant government institution for investigation under law. When there is a request from the Information Communication Ethics Committee. When there is a request in accordance with the procedures stipulated in the relevant laws and regulations.

Article 10 (Member's obligation)
  1. ① A member shall not be engaged in the following acts:
    1. 1. Using another person’s ID or PASSWORD.
    2. 2. Making false statements concerning other specified person
    3. 3. Medicircle copyright, infringe on a third party copyright and other rights
    4. 4. Actions to disseminate content that violates the public order and morals
    5. 5. Actions associated with objectively judged as crime
    6. 6. Other illegal or dishonest acts
  2. ② The customer should not perform sales activities using the service without prior approval from the company, and Medicircle will take no responsibility over the outcome of the sales activity. In addition, the customer should be liable for damage that the company suffered due to those sales activities.
  3. ③ Members are not transferable to any other person, or other use of the contractual status of the service.

Chapter 4: Service Subscription

Article 11 (Member's obligation)
  1. ① Members will have the responsibility for managing their e-mail, message boards, registration materials and other maintenance needed.
  2. ② Data deleted by Medicircle members, cannot be changed.
  3. ③ The customer should not commit behavior that can disturbs business, and brings dishonor to Medicircle.
  4. A member shall be solely responsible for any result that may be caused by his/her matters posted, including infringement of others’ copyright.
Article 12 (Management and deletion of posts)

Contents may be kept for a limited number of days, to reserve memory space and can be deleted without notice.

  1. 1. Contents defaming Medicircle, another member, or a third party through slander and if the focus is in violation of ''good morals and offenses.
  2. 2. Contents disturbing public order or established social customs and morals.
  3. 3. Contents associated with a criminal act.
  4. 4. Contents infringing on a third party’s copyright or other rights.
  5. 5. Contents not in alignment with the nature of the Service.
  6. 6. Contents in violation of other relevant laws or regulations or rules.
Article 13 (Post Copyright)

A member shall not use information or material provided by the Service for a commercial purpose, including rearrangement or sale of such material

Article 14 (Service hours)

The Service will be provided around the clock, and the service may be temporarily stopped when there is an internal problem or an operational requirement. This includes periodical system checks, in which case will give users the relevant notice.

Article 15 (Service Liability)

Medicircle will not be responsible for any activities of misconduct or misuse or services related to the company or website related services

Article 16 (Suspension of Service)

If it corresponds to the following acts.

  1. 1. If unavoidable due to the construction of site or other services such as maintenance
  2. 2. Stopping the service due to service provider
  3. 3. If a system check is required
  4. 4. Or any other reason

Chapter 5 Termination and Limitation

Article 17 (Termination and Limitation)
  1. ① The member can withdraw membership from Medicircle at any time, and can take necessary actions including the deletion of the posted article.
  2. ② Medicircle members will have an opportunity to make a statement following notified measures to terminate use of the customer to 30 days.
    1. 1. If the user uses other's personal information, user ID, or password illegally
    2. 2. If the user disturbs service operation intentionally
    3. 3. If the user registered the false information while applying membership
    4. 4. If the user duplicates, or uses the information with other ID
    5. 5. If the user commits behavior that is prohibited
    6. 6. If the act is to damage another person's honor.
    7. 7. In the case of transmitting a large amount of information in order to interfere with the stable operation of the service, or send advertisement information
    8. 8. If you disseminate such programs that distributes viruses that cause malfunctions or destruction of such information
    9. 9. If you violate Medicircle or any member or third party intellectual property rights
    10. 10. In the case of using fraudulently the user ID and the password of others personal information
    11. 11. If homepage or bulletin board members will post obscene content or links to it
    12. 12. If it is determined, that it is in violation of other related laws

Chapter 6 Others

Article 18 (Prohibition of Transfer)

The use of the service and other contractual rights are not transferable to other and cannot be offered as collateral.

Article 19 (Damages)

Medicircle service is provided free of any damage, and in the event of losses caused to its members in connection with any service provided and damages caused intentionally or by negligence, Medicircle will not be responsible for it.

Article 20 (Disclaimer)
  1. ① In case of natural disaster, war or other related force of majeure, Medicircle will be exempt from the responsibility of delivery of service
  2. ② Services related to maintenance of equipment, replacement, periodic inspection, construction, etc. We are not responsible for the damages caused by unavoidable reasons, there for Medicircle is exempt.
  3. ③ Medicircle is not responsible for the failure of services due to reasons attributable to the member.
  4. ④ Medicircle is not liable for damages caused by other material or services you expect to get through with a membership service.
  5. ⑤ Medicircle is not responsible for the published member information, materials, etc. As for the content reliability and accuracy of facts.
Article 21 (Jurisdiction)

If lawsuit for disputes with service occurs only to the court's exclusive jurisdiction premises of Medicircle location.
